1. Agreement
These Terms of Service (“Terms”) govern the use of BuHire, an AI-native applicant tracking and recruiting platform provided by NetIT SAS, a French company with its registered office at 32 rue de Paris, 92100 Boulogne-Billancourt, France (“NetIT”, “we”, “us”). They form an agreement between NetIT and the organization that creates an account or places an order (the “Customer”). If you use BuHire on behalf of an organization, you confirm that you have the authority to bind it to these Terms.
BuHire is for professional use by organizations. It is not offered to consumers.
2. The Service
The Service includes the BuHire web application at app.buhire.com and its features, such as job postings, candidate and pipeline management, career pages, interview scheduling, email sequences and workflows, and AI-assisted features. We may add, change or remove features. A feature described as upcoming is not part of the Service until it is released.
3. Accounts and access
- The Customer’s administrators invite users and assign roles. The Customer is responsible for the users it authorizes and for the activity under their accounts.
- Users must keep their credentials confidential and are encouraged to enable two-factor authentication.
- Please tell us promptly at contact@buhire.com if you suspect unauthorized access.
4. Customer data and responsibilities
The Customer owns the data it puts into the Service, including candidate data (“Customer Data”) and grants NetIT the right to host and process it to provide the Service.
The Customer is responsible for:
- having a lawful basis to collect and process candidate data, and giving candidates the notices required by law;
- obtaining consent where consent is required, and keeping Customer Data accurate;
- complying with employment, anti-discrimination and data protection laws that apply to its recruiting activities, including the GDPR where applicable;
- using the tools provided in the Service to handle requests from candidates, such as data export, erasure and consent withdrawal.
Where NetIT processes personal data on the Customer’s behalf, the Customer is the controller and NetIT is the processor. Our Privacy Policy describes how we handle data, and a data processing agreement is available on request.
5. AI features
- AI features provide suggestions, drafts, scores and extracted information. They can be incomplete or inaccurate.
- The Customer must review AI output before relying on it. BuHire does not make final hiring decisions, and the Customer must not use the Service to make them automatically.
- The Customer is responsible for complying with laws that regulate automated tools in employment decisions in the places where it recruits.
6. Third-party services
The Service can connect to third-party services, such as Google Calendar. These connections are optional. Third-party services are governed by their own terms, and we are not responsible for them. When Google Calendar is connected, information about interviews, which includes the candidate’s name and the job title, is written to the connected user’s Google Calendar. BuHire’s use of Google user data is described in our Privacy Policy and follows the Google API Services User Data Policy, including the Limited Use requirements.
7. Acceptable use
You must not:
- use the Service in a way that is unlawful or that discriminates unlawfully against any person;
- send unsolicited or misleading messages, or use email sequences and workflows in breach of anti-spam and electronic communication laws such as CAN-SPAM, the GDPR and ePrivacy rules, or CASL. The Customer is responsible for having a legal basis to contact each recipient and for honoring opt-outs;
- access the Service by automated means other than the interfaces we provide, scrape it or attempt to bypass its security or limits;
- reverse engineer the Service, or introduce malware or content that is harmful or infringing;
- resell or provide the Service to third parties without our written agreement.
We may suspend access, including email sending, if we reasonably believe these rules are being broken or the Service is at risk.
8. Fees and plans
Fees are set in the order form or in the pricing we communicate to the Customer. Plans may include limits, such as usage allowances for AI features.
9. Intellectual property
NetIT and its licensors own the Service, including its software, design and trademarks. We grant the Customer a limited, non-exclusive, non-transferable right to use the Service during the term. The Customer keeps all rights in Customer Data. If the Customer sends us feedback, we may use it to improve the Service without obligation.
10. Confidentiality
Each party will keep the other’s non-public information confidential, use it only for the purposes of these Terms and protect it with reasonable care, except where disclosure is required by law.
11. Availability and support
We make commercially reasonable efforts to keep the Service available and to provide support by email at contact@buhire.com. We may perform maintenance and updates. Unless agreed in writing, we do not commit to a specific service level.
12. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, and we disclaim implied warranties, including fitness for a particular purpose. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Limitation of liability
To the extent permitted by law, NetIT is not liable for indirect or consequential damages, loss of profits or loss of data, and its total liability under these Terms is limited to the fees paid by the Customer in the twelve months before the event giving rise to the claim.
14. Term and termination
These Terms apply while the Customer uses the Service. The Customer may stop using it at any time, and either party may terminate for a material breach that is not remedied within a reasonable period. We may suspend access for non-payment or to protect the Service. After termination, the Customer can export its data for a limited period before it is deleted.
15. Changes to these Terms
We may update these Terms. For material changes, we will notify the Customer’s administrators by email or in the application before they take effect. Continued use after the effective date means the Customer accepts the updated Terms.
16. Governing law and disputes
These Terms are governed by French law. The courts of Nanterre, France, have jurisdiction, subject to mandatory rules that apply to the Customer.
17. General
These Terms and the order form are the entire agreement between the parties on their subject. If a provision is unenforceable, the rest remains in effect. Neither party may assign these Terms without the other’s consent, except to a successor in a merger or sale of its business. Neither party is liable for delays caused by events beyond its reasonable control.
